Ms. Obetz:
The fact wsituation you relate is clearly a matter relating to personal injury tort law. Since there are significant differences among the states in various categories relating to tort law I would suggest that you consult with an attorney experienced in tort law in Montana. If you are not familiar with an attorney, you should contact the "referral service" of your local county bar association. It is almost universally true that personal injury attorneys will not charge a fee for consultations. Feel absolutely free to ask the attorney about his fee arrangement BEFORE you enter into further discussion.

Have a question concerning construction negligence. 18'x16"x7' area of exposure on construction dig. Victim fell in during a late evening walk, over grass. The construction orange plastic 'fencing' was down, as were the cones which signified the area of caution. Pictures were taken the next morning showing the openness of the exposed area, and the victim's hat was in the bottom of the hole, filled with rocks and rebar. In what area of Montana law would this case be considered?
